Madras HC orders U/A certification for Vijay’s Jana Nayagan; CBFC moves Chief Justice seeking appeal

While Justice PT Asha directed the CBFC to provide the U/A certificate for Jana Nayagan, the censor board has appealed to the Chief Justice against her order

On Friday, Madras High Court Justice PT Asha directed the Censor Board for Film Certification (CBFC) to grant the U/A 16+ censor certificate for Vijay's swansong, Jana Nayagan. The film, which was slated for release on Friday, January 9, was postponed due to the censorship issue.

As per reports, the Justice asked how a film can be sent for re-examination based on a complaint from a single member. Furthermore, she also said, "Once a U/A certificate has been granted to a film, the chairperson’s authority comes to an end."

After saying that "Sending the film again for re-examination is unacceptable," PT Asha set aside the order which directed the film to be sent for censor re-examination.

Following the verdict, Additional Solicitor General ARL Sundaresan, appearing for the CBFC, mentioned before Madras High Court Chief Justice Manindra Mohan Shrivastava seeking an urgent hearing of the writ appeal against Justice PT Asha’s order in the Jana Nayagan case. The Chief Justice-led bench said that if the petition is filed, the bench will consider hearing it this afternoon. The Censor Board requested that the petition be heard on Monday.

Previously, on January 7, the ASG submitted all complaints filed against Jana Nayagan, including one filed by the member of the examining committee that watched the film. Then, Justice PT Asha questioned the move of the CBFC to review the certificate.

The ASG argued that the chairperson of the CBFC has the power to task a committee to review the certification, as in the end, the certificate is issued by the CBFC. The ASG argued that if the chairman wasn't satisfied by the examining committee's decisions, the chairman could call for a review.

Satish Parasaran, representing KVN Productions, who are backing the Vijay-starrer, argued that if the examining committee had already reviewed the film and recorded their recommendations, then how can one member file a complaint?

As the verdict for the case was pushed to Friday, January 9, the makers of the H Vinoth directorial announced the postponement of the film. Jana Nayagan also stars Mamitha Baiju, Pooja Hegde, Prakash Raj, Bobby Deol, Gautham Vasudev Menon and Priyamani, among others. The postponement was met with a lot of dejection from fans, as the film marks Vijay's final outing before his full-fledged stint in politics.
