Jana Nayagan: The Madras High Court has stayed the single judge's order, directing the Central Board of Film Certification (CBFC) to provide certification to Vijay-starrer Jana Nayagan. At a hearing in the High Court which saw arguments from the Solicitor General Tushar Mehta and Additional Solicitor General AR L Sundaresan, for the CBFC, and advocates Mukul Rohatgi and Sathish Parasaran, for producers KVN Productions, the Chief Justice passed his judgement for the appeal filed by the CBFC.
While the representatives of the CBFC argued that after the judgement of Justice PT Asha, they were not given time to file a counter affidavit. They also argued that the Justice PT Asha had quashed the order of the Chairman of the CBFC, even though the appeal wasn't filed for that reason.
The Chief Justice also questioned the move of the producer to create a false sense of urgency by announcing a release date before issuance of certification.
The representatives of the production house argued that the film was certified UA 16+ on December 22, and including carrying out excisions, the required steps for receiving certification was completed on December 29.
The Chief Justice reiterated that when a certification wasn't in hand a release date should not have been announced.
In the end, the Chief Justice ordered a stay on Justice PT Asha's orders. The next hearing for the writ appeal, filed by the CBFC, is scheduled for January 20.
Meanwhile, KVN Productions, is reportedly filing an appeal with the Supreme Court on Monday.
