Supreme Court stays order to compensate teacher over Jabra Fan row

The Supreme Court has stayed an order by the National Consumer Disputes Redressal Commission (NCDRC) to compensate a consumer for the exclusion of the Jabra Fan song in the 2016 Shah Rukh Khan-starrer Fan, PTI reported. 

The complainant, Afreen Fatima Zaidi, a teacher, was aggrieved that the song featured in the film's promos was not included in the theatrical version, which she went to watch with her children. She had complained that her children did not eat food that night feeling disappointed that the song was excluded from the film. This allegedly resulted in a spike in their acidity levels and hospitalisation.

After being rejected by the concerned district forum, Afreen's complaint was upheld by the Maharashtra State Consumer Commission, which in 2017 directed Yash Raj Films to compensate her with Rs 10,000 along with litigation costs. The order was challenged by the production house. 

According to the PTI report, Yash Raj Films submitted that the complainant cannot be said to be a consumer. It also stated that the track Jabra Fan was shown on TV channels as a promotional trailer and it had been disclosed through press interviews that it is not a part of the film.
